To help capture images of the community in our Bank calendar, Clear Mountain Bank invites photographers from all levels of expertise to enter the 2020 Clear Mountain Bank Calendar Photography Contest (“Contest”). Winning images have the opportunity to be published in the 2020 Clear Mountain Bank calendar as well as being displayed as a part of an exhibition at the Bank’s banking offices.
Please read the following rules carefully!
WHO: The competition is open to ALL photographers at least 18 years of age. Your entry to the contest constitutes your agreement to allow your photographs – and your name, city and state of residence – to be published as selected award winners in the 2020 Clear Mountain Bank calendar; exhibited at the Bank’s banking facilities and other public venues; published or used on websites owned or operated by Clear Mountain Bank as award winners; and used for promotions of Clear Mountain Bank including, but not limited to, a photo contest calendar, a compilation book or electronic collection of winners, online photo features and contests, and web pages providing information, updates, rules and photography tips. Clear Mountain Bank shall have the right to verify, in its sole judgment, winner eligibility.
WHAT: We are looking for striking images of community events, buildings, nature, creatures on land and life beneath the water’s surface, or other depictions of our communities in North Central West Virginia and Western Maryland. These images may show animal behavior, portraits of wildlife in natural habitat, plant life, natural landscapes, weather, people interacting with nature, community events, landmarks, structures, etc. Please do not include photographs of pets or domestic animals. Images of captive animals photographed in game farms will be disqualified. Images will be judged on originality, technical excellence, composition, overall impact and artistic merit. Decisions made by the judges are final. Entrants must not infringe on the rights of any other photographer or person or submit images that involve the willful harassment of wildlife or damage to the environment by the photographer. All photographs should accurately reflect the subject matter and the scene as it appeared. Photos that have been digitally altered beyond standard optimization (removal of dust, cropping, adjustments to color and contrast, etc.) will be disqualified.
WHEN: Photos may be submitted beginning on June 1, 2019. Deadline for submitting entries is July 31, 2019. Entries must be actually received by Clear Mountain Bank by 11:59 p.m. on July 31, 2019. Receipt of entries cannot be acknowledged. Winners will be announced by October 1, 2019. Electronic entries are strongly encouraged. Due to the large number of entries received, any mailed or shipped entries cannot be returned.
WHY: Prizes will be awarded as described below. A selection of winning photos may appear in next year’s Clear Mountain Bank calendar and possibly in an exhibition at the bank’s offices and web site. A public online vote may be utilized to help determine the winners. Prizes will be awarded to the thirteen winning images. Each of the thirteen winners will receive a $50 prize. Additional winners may be selected as Honorable Mention Winners and will receive a $25 prize. Clear Mountain Bank reserves right to limit winning photographs to one per person.
HOW: A total of up to 5 photographs may be submitted per entrant. It is strongly recommended that photographs are submitted in electronic format. Please note that landscape orientation of photos is best.
Electronic Entries: Electronic entries may be uploaded by clicking on the calendar photo contest link at www.clearmountainbank.com. Electronic submissions must be in either JPEG or TIFF format. Original files of camera-made digital photos must be three (3) mega pixels or larger. Entries may also be saved on a compact disk and mailed, shipped or delivered to Clear Mountain Bank, Calendar Photo Contest, P.O. Box 205, Bruceton Mills, West Virginia 26525. Due to the large number of entries received, any mailed or shipped entries cannot be returned.
Identifying Information: Each entry must identify the photographer’s name, address, phone number, and email address as well as a brief description of where, when and how the photograph was taken. Entries failing to provide this information are subject to disqualification. Clear Mountain Bank cannot be responsible for lost, damaged, late or misdirected entries, or for uploading connections, garbled transmissions, unauthorized intervention or technical malfunctions.
LEGAL DISCLAIMERS: By entering, participants release and hold harmless Clear Mountain Bank, Inc., its parent, subsidiary and affiliated companies as well as their directors, officers, employees, attorneys, agents and representatives from any and all liability for any injuries, loss, claim, action, demand or damage of any kind arising from or in connection with the calendar photo contest.
Outside of the thirteen prizes awarded to the winning calendar photo entries, there will be no additional fees paid by the bank to participants for use of their photographs. Winning participants will be required to sign an additional agreement and waiver form prior to receiving their prize. Participant agrees that any and all disputes that cannot be resolved with the Clear Mountain Bank, and causes of action arising out of or connected with the Clear Mountain Bank, shall be resolved individually, without resort to any form of class action, before a court of competent jurisdiction located in Preston County, West Virginia, which court shall apply the laws of the State of West Virginia without regard for rules of conflicts of law. In any such dispute, participant shall, under no circumstances, be entitled to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (if any) associated with participating in the photo contest. Participant hereby waives all rights to have damages multiplied or increased.
Clear Mountain Bank is not responsible for any incorrect or inaccurate information, whether caused by users or by any equipment or programming associated with or utilized by Clear Mountain Bank, or by any technical or human error that may occur in the processing of submissions to Clear Mountain Bank, including but not limited to any misprints or typographical errors. Clear Mountain Bank assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Clear Mountain Bank is not responsible for any problems or technical malfunction of any telephone network or lines, computer equipment, servers, providers, computer on-line systems, software, or failure of email on account of technical problems or traffic congestion on the Internet or at any website, including injury or damage to participant’s or to any other person’s computer related to or resulting from participating or uploading images or information.
If, for any reason, Clear Mountain Bank is not capable of contest completion as planned, Clear Mountain Bank reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest. Clear Mountain Bank reserves the right to use photographs not submitted as a part of this contest in its 2020 calendar.
In no event will Clear Mountain Bank, its parent, subsidiary, or affiliated companies or their respective advertising and promotional agencies, directors, officers, employees, attorneys, agents and representatives be responsible or liable for any damages or losses of any kind as a result of this contest.
